Acceptance of Terms

Please read these Terms of Use ("Terms") carefully before using TallyBoxHQ. These Terms are a binding contract between you and 3SHTech Ltd ("Company," "we," "us"). By accessing or using TallyBoxHQ, you agree to be bound by these Terms. PLEASE NOTE THAT YOUR USE OF AND ACCESS TO OUR SERVICES (DEFINED BELOW) ARE SUBJECT TO THE FOLLOWING TERMS; IF YOU DO NOT AGREE TO ALL OF THE FOLLOWING, YOU MAY NOT USE OR ACCESS THE SERVICES IN ANY MANNER.

As part of the 3SHTech Ltd family of applications, this Term and Conditions incorporates and is supplemented by our parent company's terms and conditions practices as outlined in the 3SHTech Terms and Conditions. Where applicable, provisions from our other applications under 3SHTech Ltd (including but not limited to SacredBox) may apply to TallyBoxHQ. When reviewing these referenced policies, please understand that references to "3SHTech," "SacredBox," or other application names should be read as applying to TallyBoxHQ where the context and provisions are relevant to our services.

These Terms include the provisions in this document, as well as those in our Privacy Policy and Copyright Policy.

Changes to Terms

We are constantly trying to improve our Services. We may update these Terms from time to time. We reserve the right to change the Terms at any time, but if we do, we will notify you by posting the updated Terms on our platform and, where appropriate, via email and/or by some other means. Your continued use of TallyBoxHQ after changes become effective constitutes acceptance of the new Terms. If you don't agree with the new Terms, you are free to reject them; unfortunately, that means you will no longer be able to use the Services.

Privacy

We take privacy seriously. Our Privacy Policy is available here.

The Children's Online Privacy Protection Act ("COPPA") requires that online service providers obtain parental consent before they knowingly collect personally identifiable information online from children who are under 13. We do not knowingly collect or solicit personally identifiable information from individuals under 18; if you are under the age of 18, please do not attempt to register for the Services or send any personal information about yourself to us. If we learn we have collected personal information from an individual under the age of 18, we will delete that information as quickly as possible. If you believe that an individual under the age of 18 may have provided us personal information, please contact us at privacy@3shtech.com.

Financial Services Disclaimer

Unless specifically disclosed, you acknowledge and agree that we are not:

  • An authorised or regulated financial institution under the Financial Services and Markets Act 2000 (FSMA) or equivalent EU regulations
  • A credit institution as defined under the Capital Requirements Regulation (CRR) or Banking Act 2009
  • An investment firm authorised under the Markets in Financial Instruments Directive (MiFID II)
  • A payment institution as defined under the Payment Services Regulations 2017 (PSRs) or PSD2
  • A payment institution licensed under the Payment Services Regulations 2017 or Payment Services Directive 2 (PSD2)
  • A consumer credit provider under the Consumer Credit Act 1974 or Consumer Credit Directive
  • A credit reference agency regulated by the Financial Conduct Authority (FCA) or equivalent EU data protection authorities
  • A debt management company, debt counselling service, or insolvency practitioner
  • An insurance intermediary or insurance undertaking under the Insurance Distribution Directive
  • A financial advisor, investment advisor, or wealth management service regulated under applicable UK or EU financial services legislation
  • A tax advisor, accountant, or legal counsel

Services Limitations

The Services are not regulated financial services, and we do not provide:

  • Investment advice, recommendations, or portfolio management services
  • Credit advice, credit repair, or debt management services
  • Insurance advice or intermediation services
  • Tax advice or accountancy services
  • Legal or professional financial planning advice
  • Credit assessments, credit scoring, or credit reporting services
  • Banking, lending, or payment processing services
Any information, analytics, or insights provided through the Services are for informational and personal financial management purposes only and should not be construed as:
  • Investment advice, recommendations, or portfolio management services
  • Credit advice, credit repair, or debt management services
  • Insurance advice or intermediation services
  • Tax advice or accountancy services
  • Legal or professional financial planning advice
  • Credit assessments, credit scoring, or credit reporting services
  • Banking, lending, or payment processing services

Regulatory Compliance and Limitations

You acknowledge and agree that:

  • No Regulatory Authority: We bear no authority under UK or EU financial services regulations to assess your eligibility for credit, insurance, investment products, or other regulated financial services.
  • No Credit Activities: We do not conduct credit checks, provide credit scores, or report information to credit reference agencies in the UK, EU, or any other jurisdiction.
  • Data Processing Only: Our Services involve processing and analysing your financial data for personal financial management purposes only, not for any regulated financial services activities.
  • Compliance Responsibility: If your use of the Services is prohibited by applicable UK, EU, or local financial services laws and regulations, you are not authorised to use the Services.
  • No Liability: We cannot and will not be responsible for your use of the Services in a manner that violates applicable financial services regulations or other laws.
  • No Endorsement: Our provision of the Services does not constitute an endorsement, recommendation, or approval of any financial products, services, or providers.
  • No Fiduciary Duty: We do not owe you any fiduciary duty or duty of care under financial services laws or otherwise.
  • No Guarantee: We do not guarantee that the Services will meet your financial needs or objectives, or that they will be free from errors or interruptions.
  • No Professional Advice: The information provided through the Services is for general informational purposes only and does not constitute professional financial, investment, tax, or legal advice.

Jurisdictional Compliance

This disclaimer applies across all jurisdictions where our Services are available, including but not limited to the United Kingdom, European Union member states, and other territories. Users are responsible for ensuring their use of the Services complies with all applicable local financial services laws and regulations.

Data Security Standards

While we implement appropriate security measures for handling your financial data, including compliance with applicable data protection regulations (GDPR) and industry standards (PCI DSS where applicable), we are not subject to the same regulatory capital, liquidity, or operational requirements as authorised financial institutions.

Account Registration

To use TallyBoxHQ, you must create an account by providing accurate, complete, and current registration information and you promise to keep it accurate and up-to-date. You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activity that occurs under your account.
  • Notifying us immediately of any unauthorised access or security breach.

You don't have the right to use, or another person's name with the intent to impersonate that person.

You must be at least 18 years old to create an account. You must not transfer your account to another person without our prior written consent and agreement from us. This will also include sharing your account with your spouse or partner or any other member that you know or don't know by sharing your credentials.

You're responsible for any activity associated with your account, including any activity of your Household Members or your Financial Professionals.

Household Features

TallyBoxHQ allows you to invite members of your household (for example, a "Partner") to share access to your financial data. By inviting a member or a partner:

  • You authorise TallyBoxHQ to share your financial data with the invited member.
  • Both members can view and manage shared accounts, income sources, and transactions.
  • You can remove a Partner at any time, which revokes their access to shared data.
  • The Primary account holder maintains administrative control over the household.

You are responsible for ensuring that you have the necessary permissions to share financial data with any invited member. You are also responsible for any actions taken by an invited member in relation to your financial data.

You may also authorise your financial professional (each, a “Financial Professional”) to access your account or otherwise use the Services on your behalf, and if you do so, you acknowledge and agree that you are authorising TallyBoxHQ to disclose your personal information to such Financial Professional. For more information, please refer to our Privacy Policy.

Additional Terms Regarding AI-Powered Services

TallyBoxHQ may from time to time offer Services that incorporate or are powered by artificial intelligence technology (for example, financial insights, spending analysis, or AI-powered financial assistants). These Services are referred to as "AI Services".

We may use third-party AI service providers to deliver these AI Services. By using AI Services, you acknowledge and agree that your data may be processed by these third-party providers in accordance with their terms and privacy policies.

You agree to use AI Services only for lawful purposes and in accordance with this Agreement only for the purpose of managing your personal finances as per the TallyBoxHQ Code of Conduct and intended use. Anything else is not permitted and is a violation of this Agreement which may result in termination of your account and any other actions as we may deem fit including legal action and recovery of any damages caused due to such violation.

By using AI Services, you acknowledge and agree to the following:

  • Nature and Limitations of AI Services
    • AI-Generated Information:The information generated by AI Services is produced through artificial intelligence and machine learning technologies. Artificial intelligence and machine learning are rapidly evolving fields of study with inherent limitations.
    • Probabilistic Technology: Given the probabilistic nature of machine learning, use of AI Services may in some situations result in incorrect, inaccurate, incomplete, or misleading information. AI systems learn from patterns in data and may not account for unique personal circumstances, market conditions, or regulatory changes.
    • No Regulatory Approval:Our AI Services are not approved, validated, or regulated by the Financial Conduct Authority (FCA), European Securities and Markets Authority (ESMA), or other relevant UK or EU financial regulatory bodies.
  • Important Disclaimers and Limitations
    • Not Financial Advice: As with all information provided by or obtained from our Services, the information provided by AI Services ("Output") does not constitute:
      • Investment advice or investment recommendations under MiFID II
      • Credit advice under the Consumer Credit Act 1974 or Consumer Credit Directive
      • Insurance advice under the Insurance Distribution Directive
      • Tax advice or accountancy services
      • Professional financial planning or wealth management advice
      • Retirement planning advice
      • Estate planning advice
      • Any other type of regulated financial advice under UK or EU law
    • No Guarantee of Accuracy:While we strive for accuracy, we do not guarantee that the Output will be error-free, complete, or accurate. AI-generated information may contain inaccuracies or omissions. You should not rely solely on the Output for financial decisions.
    • Not a Substitute for Professional Advice:AI Output does not substitute for advice from appropriately qualified and FCA-authorised (or equivalent EU-regulated) professionals. You must verify the accuracy and suitability of any Output with a qualified professional before making any financial decisions.
    • No Fiduciary Duty:Our provision of AI Services does not create a fiduciary duty or any special relationship between you and us. We do not act as your financial advisor, fiduciary, or trustee.
    • No Liability for Decisions:You are solely responsible for any decisions you make based on the Output. We will not be liable for any losses, damages, or other consequences arising from your use of or reliance on the Output.
    • No Liability for Inaccuracies:We will not be liable for any inaccuracies, errors, or omissions in the Output, or for any loss or damage arising from your use of or reliance on the Output.
    • No Liability for Changes:We may change, suspend, or discontinue the AI Services at any time without notice. We will not be liable for any loss or damage arising from such changes.
    • Personal Responsibility:You acknowledge that relying upon any AI Output without first verifying its accuracy and appropriateness with qualified professionals could result in:
      • Inappropriate insurance coverage
      • Inappropriate investment decisions
      • Inappropriate tax decisions
      • Inappropriate retirement planning decisions
      • Inappropriate estate planning decisions
      • Inappropriate financial planning decisions
      • Inappropriate wealth management decisions
      • Inappropriate financial decisions
      • Financial losses or missed opportunities
      • Legal consequences or regulatory violations
      • Tax implications or compliance issues
      • Inappropriate financial decisions for your circumstances
      • Other forms of harm including but not limited to legal, financial, and personal detriment
  • Compliance with UK and EU Regulations
    • Data Processing:Our AI Services process your financial data in accordance with applicable data protection regulations including the UK GDPR and EU GDPR. By using AI Services, you consent to automated processing of your personal data for the purposes described in our Privacy Policy.
    • No Automated Decision-Making:Our AI Services provide information and insights only. We do not use AI for automated decision-making that would significantly affect you under data protection law, including decisions about credit, insurance, or investment products.
    • Market Abuse Prevention:You acknowledge that any market-related insights or information provided by AI Services must not be used in a manner that could constitute market abuse under the UK Market Abuse Regulation or EU Market Abuse Regulation.
  • User Responsibilities and Restrictions
    • Personal Use Only: You will only use the Output provided by AI Services for your own personal, non-commercial financial management purposes, and will not:
      • Make any resulting information available publicly
      • Share AI Output with third parties for commercial purposes
      • Use AI Output to provide advice to others
      • Redistribute or resell any AI-generated insights
    • Appropriate Use: You will not:
      • Include any unnecessary, deceptive, misleading, or inappropriate inputs in connection with your use of AI Services
      • Attempt to manipulate AI Services to generate inaccurate, harmful, or misleading Output
      • Use AI Services for any purpose that violates applicable UK or EU financial services regulations
      • Input information belonging to third parties without proper authorization
    • System Limitations: You understand and accept that AI Services may:
      • Experience technical failures, interruptions, or inaccuracies
      • Become temporarily unavailable for maintenance or updates
      • Change in functionality or availability without notice
      • Have limited understanding of complex personal financial situations
    • Additional Protections for UK/EU Users
      • Consumer Rights:Nothing in these terms affects your statutory rights as a consumer under UK or EU consumer protection law.
      • Regulatory Compliance:If you are a regulated professional (such as an IFA, accountant, or lawyer), you remain responsible for ensuring your use of AI Services complies with your professional obligations and regulatory requirements.
      • Data Portability:In accordance with UK and EU data protection law, you may request access to, correction of, or deletion of personal data processed by our AI Services.
      • Transparency:We will provide reasonable information about how our AI Services work, subject to protecting proprietary technology and trade secrets.
    • Limitation of Liability
      • No Warranties:We provide AI Services on an "as is" basis without warranties of any kind, whether express or implied, including but not limited to warranties of accuracy, completeness, reliability, or fitness for a particular purpose.
      • Limitation:To the maximum extent permitted by applicable UK and EU law, we exclude liability for any losses arising from your use of or reliance on AI Services, except where such exclusion would be prohibited by law (such as for fraud, death, or personal injury caused by negligence).

Professional Advice Recommendation

For any financial decisions, including but not limited to investments, borrowing, insurance, tax planning, or pension arrangements, you should:

  • Consult with appropriately qualified and regulated financial advisors
  • Seek advice from FCA-authorised (or equivalent EU-regulated) professionals
  • Verify that any financial services provider you engage with holds proper regulatory authorisation
  • Consider your individual circumstances, risk tolerance, and financial objectives
  • Not rely solely on AI-generated insights for making significant financial decisions
  • Conduct your own due diligence before committing to any financial product or service
  • Understand that AI-generated insights are for informational purposes only and do not constitute financial advice
  • Be aware that AI models may make mistakes, and you should verify important information independently
  • Not use AI-generated insights to make decisions that could adversely affect your financial well-being
  • Consult with a qualified financial advisor for personalised guidance tailored to your specific situation

Permitted Use

You may use TallyBoxHQ only for your own personal, non-commercial financial management purposes. You agree not to:

  • Use the service for any unlawful purpose or in violation of any applicable law.
  • Attempt to gain unauthorised access to any part of the service or its systems.
  • Use automated tools, bots, or scripts to access or interact with the service.
  • Reverse engineer, decompile, or disassemble any aspect of the service.
  • Upload malicious code, viruses, or harmful data.
  • Interfere with or disrupt the integrity or performance of the service.
  • Share your account credentials with third parties.

You're free to stop using TallyBoxHQ at any time. We're sorry to see you go, but we understand that circumstances change. You can do that by contacting support at support.tallyboxhq@3shtech.com. please refer to our Privacy Policy, as well as the licenses above, to understand how we treat information you provide to us after you have stopped using our Services.

We're also free to terminate (or suspend access to) your use of the Services or your account, for any reason in our discretion, including your breach of these Terms. 3SHTech Ltd has the sole right to decide whether you are in violation of any of the restrictions set forth in these Terms. Account termination may result in destruction of any Content associated with your account, so keep that in mind before you decide to terminate your account. We will try to provide advance notice to you prior to our terminating your account so that you are able to retrieve any important User Submissions you may have stored in your account (to the extent allowed by law and these Terms), but we may not do so if we determine it would be impractical, illegal, not in the interest of someone's safety or security, or otherwise harmful to the rights or property of 3SHTech Ltd.

If you have deleted your account by mistake, contact us immediately at support.tallyboxhq@3shtech.com, we will try to help, but unfortunately, we can't promise that we can recover or restore anything. Financial Data Disclaimer

TallyBoxHQ is a financial tracking and visualisation tool. It is not a financial adviser, tax adviser, or investment platform. The information displayed in TallyBoxHQ:

  • Is based on data you provide and may not be fully accurate or up to date.
  • Should not be relied upon as the sole basis for any financial decision.
  • Does not constitute financial, tax, or investment advice.

We strongly recommend consulting a qualified financial professional before making significant financial decisions.

Intellectual Property

TallyBoxHQ, including its design, code, logos, trademarks, and content, is the property of 3SHTech Ltd and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of TallyBoxHQ without our express written permission.

Service Availability

We strive to maintain high availability of TallyBoxHQ but do not guarantee uninterrupted access. We may temporarily suspend or restrict access to perform maintenance, updates, or address security concerns. We will endeavour to provide advance notice where practicable.

Limitation of Liability

To the fullest extent permitted by law, 3SHTech Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of TallyBoxHQ.

Our total liability for any claim relating to the service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or £100, whichever is greater.

Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your account if you violate these Terms. Upon termination:

  • Your right to access TallyBoxHQ ceases immediately.
  • We will delete your data in accordance with our Privacy Policy.
  • Provisions that by their nature should survive termination will remain in effect.

Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
